Pablo Aguilar-Alvarez, 36, was convicted of his fourth felony DWI within the past 10 years after prosecutors said he drove erratically in Southampton with a blood alcohol content of .17%, more than twice the legal limit.
A Suffolk County jury found Aguilar-Alvarez guilty Aug. 7 of driving while intoxicated per se and driving while intoxicated, both Class D felonies, along with second-degree aggravated unlicensed operation of a motor vehicle, an unclassified misdemeanor.
According to the Suffolk County District Attorney’s Office, Aguilar-Alvarez was driving with his girlfriend at about 1:24 a.m. on Nov. 29, 2025, after an evening of drinking.
Prosecutors said the pair stopped at the USA Gas Station at Flanders Road and Longneck Boulevard in Southampton to purchase additional alcohol. While inside the store, Aguilar-Alvarez’s girlfriend asked the clerk to call 911.
The two then drove away, prosecutors said.
Southampton Town police received a description of the vehicle and its license plate and later located it. Officers saw Aguilar-Alvarez fail to stop at a stop sign and cross the double yellow center line on Longneck Boulevard before pulling the vehicle over, according to prosecutors.
When the vehicle stopped, Aguilar-Alvarez got out through the passenger side in an attempt to conceal that he had been driving, prosecutors said.
He failed standardized field sobriety tests and agreed to a chemical breath test that showed a .17% blood alcohol content, according to the DA’s office.
Following the guilty verdict, prosecutors asked County Court Judge Bryan L. Browns to remand Aguilar-Alvarez into custody. The DA’s office cited his four felony DWI convictions and said prosecutors had reason to believe he was planning to flee Suffolk County.
Browns denied the request and released Aguilar-Alvarez pending sentencing on Oct. 2.
He faces a maximum sentence of 2 1/3 to seven years in prison.
The DA’s office said Aguilar-Alvarez was previously convicted of aggravated DWI, a Class D felony, in June 2022; DWI, a Class E felony, in October 2017; driving while ability impaired by combined drugs and alcohol, a Class E felony, in April 2017; and misdemeanor DWI in May 2012.
Prosecutors said records show Aguilar-Alvarez, a Salvadoran national, was deported from the United States on March 1, 2024, based on his prior felony convictions and is currently illegally present in the country.
