Valley Stream Man Charged With DWI Under Leandra’s Law With 3-Year-Old in SUV

A Valley Stream man was arrested after Nassau County police said he drove drunk with a 3-year-old girl in his SUV on Saturday night.

Elmer Martinez-Serrano, 28, was charged with aggravated driving while intoxicated under Leandra’s Law, along with DWI and endangering the welfare of a child, police said.

Officers spotted a 2024 Honda CR-V traveling west on Sunrise Highway and failing to maintain its lane at about 10:44 p.m. Sept. 5, according to police.

Police said officers activated their emergency lights and sirens and stopped the vehicle near Brooklyn Avenue and Sixth Street in Valley Stream.

An investigation determined Martinez-Serrano was intoxicated, and he was placed under arrest, police said.

A 3-year-old girl was riding in the vehicle at the time. She was released to a family member, and no injuries were reported.

Martinez-Serrano was also charged with multiple vehicle and traffic law violations.

Police said he was scheduled to be arraigned Sunday, Sept. 6, at First District Court in Hempstead.
