A Huntington Station man was indicted after authorities said they seized loaded illegal rifles, a revolver, large-capacity magazines and firearm-manufacturing materials from his residence.
Matthew Hibner, 36, was arraigned June 4 before Suffolk County Supreme Court Justice Philip Goglas on weapons charges, Suffolk County District Attorney Raymond Tierney said.
Prosecutors said law enforcement searched Hibner’s residence on May 14 and recovered four loaded illegal rifles, a Tramps Terror revolver and two illegal ammunition magazines. Authorities also said they found gun tools, four pistol kits with assembly instructions, unserialized lower and upper receivers, and parts needed to assemble additional firearms.
Two of the seized rifles and numerous receivers allegedly had no serial numbers or manufacturer names, prosecutors said. The two magazines were allegedly large-capacity magazines under New York law because they could hold more than 10 rounds.
The Suffolk County Crime Laboratory tested the firearms and found them operable, according to prosecutors. Hibner allegedly did not have a permit, license or other legal authority to possess the weapons.
Hibner was indicted on five counts of second-degree criminal possession of a weapon, Class C violent felonies, and three counts of third-degree criminal possession of a weapon, Class D violent felonies.
Goglas ordered Hibner remanded while the case is pending. He is due back in court July 9 and faces up to 15 years in prison if convicted of the top count. He is represented by The Legal Aid Society.
The charges are accusations. Hibner is presumed innocent unless proven guilty.
